These Terms and Conditions are a contract (the “Terms and Conditions” or “Terms”) between you and/or your company (collectively, “you”) and The Christian Post and certain of its subsidiaries (collectively, “The Christian Post,” “Company,” “CP,” “us” or “we”) and apply to your use of The Christian Post digital properties and websites, including www.ChristianPost.com, and our mobiles sites, mobile applications, products, and services (collectively, “Services” or “Website”). These Terms incorporate by reference other applicable terms and policies, including our Privacy Policy and our Permissions Policy. These Terms require arbitration of disputes on an individual basis without class actions. If you do not agree to these Terms, then you may not use the Website.
The Website
Welcome to The Christian Post! As used in these Terms and Conditions, the term “Website” refers to the Website located at www.ChristianPost.com as well as online services that include, but are not limited to, our email newsletters, our archives, our premium online content, our mobile sites and applications, RSS, API, software, other downloads, and our online discussion forums. You agree that your use of the Website is subject to these Terms and Conditions.
Dispute Resolution; Arbitration Agreement
Under this Arbitration Agreement, you waive your right to a jury trial and bring a class action.
What is arbitration?
Legal disputes are often resolved in a court of law in front of a judge or jury; court cases are a matter of public record. Arbitration is a less formal and more private way of resolving disputes. Instead of going to court, the parties give their arguments and evidence to an arbitrator, and the arbitrator decides who “wins” the case by applying the law in the same way that a judge would.
What is our Arbitration Agreement?
Under these Terms, ANY DISPUTE OR CLAIM BETWEEN YOU AND US RELATING TO YOUR USE OF THE WEBSITE OR SERVICES, THESE TERMS, THE PRIVACY POLICY, OR ANY OF THE OTHER TERMS OR POLICIES LISTED IN THE TERMS MUST BE RESOLVED EXCLUSIVELY THROUGH BINDING ARBITRATION. This means that we will only resolve our legal disputes through arbitration and not in a court of law. Without this Arbitration Agreement, you would have the right to sue in court with a jury trial. This Arbitration Agreement will be construed in accordance with the Federal Arbitration Act.
How will the arbitration work?
The arbitration must be filed and conducted through JAMS (www.jamsadr.com) which is a provider of arbitration services in the United States and internationally, unless the parties mutually agree on another arbitration forum (which the parties shall do if JAMS is unavailable for any reason). JAMS’ Streamlined Rules will apply to the arbitration. All claims, remedies, and defenses that either you or we have under applicable law (whether federal, state, or local) will remain available to us in the arbitration. Each of us will participate in choosing a neutral arbitrator using the process in the Streamlined Rules. Unless you waive this requirement, the final arbitration hearing (which is like a trial) will take place in person at the JAMS facility closest to your residence. The arbitrator’s award will consist of a written statement explaining the arbitrator’s decision on each claim. The award will include a concise written statement of the findings of fact and conclusions of law on which the award is based. The arbitrator must follow applicable law, and any award may be challenged if the arbitrator fails to do so. If numerous substantially similar claims are filed against either you or us by multiple parties (i.e., more than three) within a six-month period, such as by the same or coordinating attorneys, either party may elect to proceed under JAMS’ Mass Arbitration Procedure and Guidelines, or any applicable mass arbitration rules, which election will be binding on all parties.
Can I file a class action?
No. You and we agree that we will only file claims against each other individually and not as a plaintiff or class member in a class action or other representative proceeding. THIS MEANS CLASS ACTIONS ARE NOT ALLOWED.
Who pays for the arbitration?
In most cases, the only fee you will have to pay to JAMS is the filing fee e.g., $250; we will pay all other arbitration costs. However, if the arbitrator decides that you filed your claim in bad faith and without any legal basis, the arbitrator can require you to pay more of the JAMS fees.
The JAMS fees do not include attorney’s fees. Regardless of who wins, you will be responsible for paying your attorney’s fees and we will be responsible for paying ours. The only exception is if the claim is brought under a law that specifically allows a party to recover its attorney’s fees. If this applies, the arbitrator may award attorney’s fees as they see fit under such law.
Are there any instances where a court will get involved?
Yes. There are things an arbitrator cannot do, like order a party to act or stop doing something—this is known as “equitable relief.” Either one of us can go to court and seek equitable relief, including by filing a motion to compel the other party to honor the arbitration agreement. However, you and we agree that the only courts where we will seek equitable relief—or file any legal proceeding outside of arbitration—are the state and federal courts located in or nearest to Washington, DC. Either party may also file any claim in a competent small claims court. These exceptions for equitable relief and small claims actions do not waive our Arbitration Agreement.
What law will apply?
The laws of the District of Columbia govern these Terms. The arbitrator will apply the District of Columbia laws to the claims in the arbitration. You agree that any claim, action, or proceeding arising out of these Terms and Conditions, or your use of the Website, shall be governed by and construed in accordance with the laws of the District of Columbia applicable to contracts to be wholly performed therein, and any action that is excluded from this Arbitration Agreement must be brought in a state or federal court in Washington, DC, without regard to conflict of law rules, and you agree to submit to the personal jurisdiction of such courts in any such cases.
Intellectual Property
The materials contained on the Website and used for the Services are provided by The Christian Post as a service to you for your noncommercial, personal use on an “as is, as available” basis and may be used by you for informational purposes only, subject to these Terms. The materials published on the Website (including, but not limited to news articles, photographs, images, illustrations, audio clips and video clips, also known as the “Content”) are protected by copyright, and owned or controlled by The Christian Post or our licensors or supplies, e.g., the party credited as the provider of the Content. You shall abide by all additional copyright notices, information, or restrictions contained in any Content accessed through the Website.
The content of Services is owned or licensed to The Christian Post or our licensors or suppliers. The Christian Post, and any licensors and suppliers, will not be liable for any delays, inaccuracies, errors or omissions in any such Content, or in the transmission or delivery of all or any part thereof, or for any damages arising therefrom.
All materials published on the Website are protected by U.S. and international copyright laws, and may not be reproduced, republished, distributed, transmitted, resold, displayed, broadcast, or otherwise exploited in any manner without the express written permission of either The Christian Post or, in the case of content licensed by The Christian Post from third parties, the entity that is credited as the copyright holder of such licensed content. Registration And Security

You are responsible for all usage or activity on your The Christian Post account, including use of the account by any third party authorized by you to use your login credentials. Any fraudulent, abusive, or otherwise illegal activity may be grounds for suspension or termination of your account, at our sole discretion, and we may refer you to appropriate law enforcement agencies.
Fees And Payments
The Christian Post reserves the right at any time to charge fees for access to portions of the Website. You will only be charged for access to the Website after we obtain your agreement to pay such charges. If we require a fee for a portion of the Website that is now free, we will give you advance notice of such fees. You may cancel your account at any time. All new fees will be posted prominently on the Website and in other appropriate locations. You agree to pay all fees and charges incurred through your account at the rates in effect for the billing period. You also agree to pay all applicable taxes relating to the use of the Website through your account.
Some products may be offered on a subscription basis. The details of your subscription, such as timing and amount of each payment, the Services included, and any restrictions or limitations thereon, will be conveyed to you when you first enroll. By purchasing a subscription, you understand and agree that your credit or debit card on file will continue to be charged for additional billing periods (e.g., monthly, annually) until you change or cancel your plan.
Billing
Subscriptions are renewed automatically each month unless you opt out per the terms and are subject to terms at checkout. You may cancel your subscription at any time as outlined below.
Cancellation And Refund Policy
1.1. Cancellation and Refunds of Digital Subscriptions
You can change or cancel your digital subscription at any time by emailing Customer Care at customerservice@christianpost.com.
When you cancel a subscription, you cancel only future charges associated with your subscription. You may notify us of your intent to cancel at any time, but the cancellation will become effective at the end of your current billing period.
Cancellations are effective the following billing cycle. You will not receive a refund for the current billing cycle. You will continue to have the same access and benefits of your product for the remainder of the current billing period.
Unless stated otherwise, THERE ARE NO REFUNDS AND ALL SALES ARE FINAL. We reserve the right to issue refunds or credits at our sole discretion. If we issue a refund or credit, we are under no obligation to issue the same or similar refund in the future.
1.2. Changes to Content or Access
We reserve the right to make changes to our digital products at any time. If we temporarily reduce or eliminate the charge for content or access that you are currently paying for under different terms, you will not receive a refund.
1.3. Cancellations by Us
We reserve the right to suspend or terminate your subscription or product for any reason, with or without notice and without further obligation. You will not be entitled to a refund in these circumstances, subject to applicable laws, provided that if a cancellation is by us and without fault by you, we may apply a pro-rated refund for any prepaid monthly, quarterly, or annual subscription plan. If the subscription is temporarily unavailable, you will not receive a refund. We reserve the right to issue refunds or credits at our sole discretion. If we issue a refund or credit, we are under no obligation to issue the same or similar refund in the future.
1.4. Changes to Subscription Content or Access
We reserve the right to make changes to our subscription products at any time. If we temporarily reduce or eliminate the charge for content or access that you are currently paying for under different terms, you will not receive a refund.
Communications With Users
The Christian Post reserves the right to send electronic mail to you for the purpose of informing you of changes or additions to the Website and send marketing communications, unless you unsubscribe and subject to applicable laws. The Christian Post reserves the right to disclose information about your usage and demographics; and advertisers and/or licensees on our Website may collect and share personal information about you, subject to the Privacy Policy. The Christian Post may also contact you via email regarding your participation in user surveys, asking for feedback on our Website or Services, or prospective products and services. This information will be used to improve the Website and Services and better understand our users.
